1. IDENTIFICATION OF THE PARTIES.

On the one hand, “JULIETH TRUJILLO GONZÁLEZ”, hereinafter NEW HOME JÁVEA, holder of Tax ID No. 53948982K, with registered address at AVD. DEL PLA 126, OF. 2.05, 03730 JÁVEA (ALICANTE), telephone number 865529689, email info@newhomejavea.com, and registered in the Valencian Community Real Estate Agents Registry under number RAICV 3982, as stated in the Legal Notice and owner of the domain WWW.NEWHOMEJAVEA.COM, hereinafter the Website, a booking portal operating in Spain. And, on the other hand, the User, the person booking accommodation in the establishment managed by NEW HOME JÁVEA, whose identifying data are those provided directly by the User through the various forms made available on the Website.

2. APPLICABLE LEGISLATION.

These General Booking Conditions (GBC) are subject to Spanish law, including: • Law 7/1998 of 13 April on General Contracting Conditions • Royal Legislative Decree 1/2007 of 16 November (Consumers and Users Act) • Royal Decree 1906/1999 of 17 December (Telephone or Electronic Contracting) • Organic Law 3/2018 on Personal Data Protection • Law 7/1996 on Retail Trade • Law 34/2002 on Information Society Services • Decree 10/2021 of 22 January regulating tourist accommodation in the Valencian Community, as amended by Royal Decree 9/2024 of 2 August.

3. SCOPE OF APPLICATION AND ACCEPTANCE.

These GBC govern all booking contracts between NEW HOME JÁVEA and the User, regardless of the booking channel: Website, email, or telephone. The User will always have access to the GBC prior to starting the booking process and may store or reproduce them. By accepting the GBC, the User declares: • That they have legal capacity to contract. • That they have read and accept the GBC. Users under 18 are not permitted to register or make bookings.

4. MODIFICATION.

NEW HOME JÁVEA may modify the GBC without affecting services already contracted, when justified, such as: • Expanding or improving services • Adapting services to technological developments • Updating prices

5. OBLIGATIONS OF THE PARTIES.

5.1. Obligations of NEW HOME JÁVEA:

• Provide contracted services with maximum guarantees
• Inform the User of the GBC prior to booking
• Provide clear and precise information on services and prices
• Provide a copy of the GBC and any applicable special conditions
• Comply with consumer protection regulations
• Issue invoices or receipts
• Register guest information as required by law

5.2. Obligations of the User:

• Comply with the GBC
• Provide truthful and updated information
• Provide required personal data for all occupants
• Provide correct payment details and pay according to the chosen method
• Respect accommodation rules and occupancy limits
• Leave the accommodation in the same condition as at check‑in
• Act diligently and in good faith
